In a suit filed April 26 in the U.S. District Court for the Southern District of New York, the Benkiser division asserts that MEM's use of the Vanilla Skies of Heaven Sent name constitutes trademark infringement and unfair competition because it creates "the likelihood of confusion or mistake as to the affiliation, connection or association of defendant with plaintiff or as to the origin, sponsorship or approval of such goods by the plaintiff." Vanilla Fields for women debuted in September ("The Rose Sheet" April 26, 1993, p. 1).
