P&G v. Aquaderm Labs

Executive Summary

Aquaderm must pay fees of $7,500 to Procter & Gamble as part of a settlement of a charge of contempt of court filed by P&G. P&G charged that Aquaderm had failed to comply with a court order barring the firm from infringing P&G's Head & Shoulders and Pert Plus Packaging by selling private label versions of the product ("The Rose Sheet" Aug. 1, p. 3). The settlement also included destruction of Aquaderm products. In addition, the settlement sets up a fining system with progressively increasing charges for each future violation of the original order. The first violation would result in a fee of $10,000 plus damages and P&G's attorney's fees
