PATENT AND TRADEMARK FILING FEES TO INCREASE IN OCTOBER, the U.S. Patent & Trademark Office announced in a notice of proposed rule-making published in the May 26 Federal Register. The Patent & Trademark Office will adjust statutory patent fees on Oct. 1 to reflect a projected 3.2% increase in the urban Consumer Price Index as calculated by the Office of Management & Budget. OMB based its U-CPI increase on projections from September 1994 to September 1995. The basic patent and trademark filing fee will go up from $730 to $750. The basic filing fee for officially designated "small entities" also increases, from $365 to $375. The fee for extension of patent term rises from $1,030 to $1,060. Seventy-five other fees associated with patents and trademarks, including maintenance fees, issue fees and post-issuance fees, also are slated to increase. The fees for petitions and for certain administrative functions, such as handling, processing and copying, will be unaltered under the PTO proposed rule. PTO says it needs to adjust its fees not only to mirror the CPI but also to "recover costs of operation, and to amend the requirements for recording an assignment to apply to documents forwarded for recording on the Government Register."
