Executive Summary

Estee Lauder v. Dep settlement: Dep prohibited from using the single letter "b" with the "basique simplified skin care" mark in product packaging or advertising for its basique skin care line as part of the settlement terms of a trademark infringement suit brought by Estee Lauder for its Clinique brand. New York Southern District Court Judge Shira Scheindlin states in the opinion that "the plaintiff has shown a likelihood of confusion between the Clinique & C mark and the use of `basique simplified skin care' with the single designation `b.'" The suit was settled Oct. 10 with the issuance of a preliminary injunction barring Dep from selling its basique line as packaged ("The Rose Sheet" Oct. 21, p. 3). The settlement allows Dep to continue using its "basique simplified skin care line" mark, as it is "not likely to be confused with the mark Clinique"...
