Estee Lauder v. Market America: Fragrance alternative manufacturer "immediately and permanently" banned from using the Beautique, White Silk and Pastures marks, according to a Dec. 28 decision filed in Manhattan federal court. Lauder filed a trademark infringement suit Nov. 3 against Greensboro, N.C.-based Market America claiming that the company's use of marks "are confusingly similar...in sound, appearance and meaning" to Lauder's Beautiful, White Linen and pleasures fragrance names. The company also charged that Market America's use of "inspired by" Estee Lauder "implies to consumers that defendant's fragrances are in some manner based upon and, hence, smell similar to the fragrance products of" Estee Lauder...
