Executive Summary

EU Court of First Justice rules against L'Oréal in favor of Revlon's Swiss subsidiary in a trademark appeals suit over the mark "Flexi Air" in a decision released March 16. L'Oréal applied to register the mark in the EU in 1998 for shampoos, gels and other hair care products, but Revlon opposed the application in 1999, citing its "Flex" trademark, also for hair care. A lower court rejected L'Oréal's application before the issue was brought before the appeals court in 2003.
