Procter & Gamble has filed separate lawsuits in U.S. Federal District Courts in Ohio against Percara Enterprises and Cumberland Swan Holdings for "trade dress infringement, trademark infringement and unfair competition involving several beauty care brands and one oral care brand," according to P&G. Additionally, case against Swan Holdings claims false advertising. Filed May 2, suits involve P&G's Herbal Essences Fruit Fusions and Pantene hair care brands as well as Secret, Old Spice, Red Zone and High Endurance antiperspirants/deodorants, among others. Percara Enterprises sells beauty products under its own brand name to a variety of retailers, while Swan Holdings manufactures and distributes private label products.
