Firm has filed suit in the Federal Court of Canada against Concord, Ontario-based Apollo Health and Beauty Care Corporation for infringement of intellectual property related to its Herbal Essences brand. Private label manufacturer "is distributing look-alike Herbal Essences shampoo and conditioner products" that infringe P&G's trademark, trade dress and design "to capitalize on the brand's success and loyalty," according to Dec. 11 release. P&G asks that Apollo be ordered to stop distributing the infringing products, recall existing inventory from store shelves and destroy the bottle molds.
