S.C. JOHNSON REQUESTING DISMISSAL OF DEP SUITE

This article was originally published in The Rose Sheet

Executive Summary

S.C. JOHNSON REQUESTING DISMISSAL OF DEP SUITE relating to dept's purchase of the Halsa and Agree hair care brands from S. C. Johnson last August. In a motion to dismiss filed March 23 and a supporting brief submitted April 11, S. C. Johnson argued that Dep's non-fraud claims are without merit because a clause of the purchase agreement for Halsa and Agree prohibits the plaintiff from suing S. C. Johnson over disagreements arising from the transaction, except those based on fraud or indemnification. A hearing begun April 18 on the motion to dismiss was extended by the judge to an as yet undetermined date.
