NAD RECEPTIVE TO COMPANY-DESIGNED PERFORMANCE TESTS TO SUPPORT AD CLAIMS, National Advertising Division Senior Attorney Barry Stelboum indicated at a June 15 workshop in Chicago on industry performance standards. Stelboum acknowledged that "historically, NAD has given a lot of weight to industry standard testing." However, he suggested that NAD reviews of advertising claims should be based on a "reasonable basis" standard, regardless of "whether [a performance test] is an industry standard test or not."
