ORTHO EXEC ACQUITTAL IN RETIN-A CASE FOLLOWS TESTIMONY by former Ortho Dermatologics Division President Lester Riley claiming that the shredding of key documents related to the promotion of Retin-A for photoaging was a result of a misunderstanding. Riley was acquitted by a Newark, NJ jury on Dec. 1 of four counts of conspiring to defraud FDA by directing the destruction of such documents. Earlier in the year, Ortho pleaded guilty to 10 counts of obstruction of justice and persuading employees to destroy documents relating to Retin-A promotion in photoaging. The Johnson & Johnson division paid a $7.5 mil. fine.
